Estate planning means much more than a will and isn't exclusively for the rich. If you do not have an estate plan, you will not be able to define how your assets will be distributed upon your passing or if you become incapacitated. Having a comprehensive estate plan dictates how your assets will be distributed and will minimize taxes and headaches to your heirs.
A prenuptial agreement is a contract prepared by an attorney and entered into by two people before their marriage. Contrary to popular opinion, prenups are not only for the rich. They are a great way to avoid arguments in the event of divorce by specifying in advance how property will be divided. Prenuptial agreements are a form of estate planning specifically for the marriage relationship.
Probate administration is the process in which a decedent’s assets are managed and distributed according to estate planning documents, such as a will, and state law. By the end of the probate process, debts and taxes should be paid, and all assets should be distributed to their new owners. Probating an estate from beginning to end may take as little as a few weeks or as long as several years, depending on the complexity of the estate and the disputes that arise.
