What is an Uncontested Dissolution?

An uncontested dissolution refers to the process of legally ending a marriage (or partnership) where both parties agree on an amicable and simple divorce and have resolved all terms of the divorce, including division of assets, child custody, and support arrangements. Since both spouses are in agreement, the uncontested divorce tends to be quicker, less complex, and less costly compared to a contested dissolution, where there are disputes that need to be resolved in court.


Key characteristics of an uncontested dissolution include:

  1. Mutual Agreement: Both parties have reached an agreement on all major issues.
  2. Simplified Process: Uncontested divorces are arguable a simple divorce process. The paperwork and court hearings are usually easier and fewer in number.
  3. Less Adversarial: The process is generally more amicable, reducing stress and conflict between the parties.
  4. Lower Costs: Because it often requires less legal work and fewer or no hearings or court appearances, the overall costs of the divorce are usually lower.

To finalize an uncontested dissolution, both parties typically submit a joint petition for divorce to the court, indicating they have chosen an uncontested divorce. They also file the marital separation agreements regarding property, custody, and support. After a review, the court will approve the uncontested dissolution without requiring a divorce trial.
